Auction terms & conditions
These general terms apply to every auction. Individual listings may include additional terms.
01Binding bids
Every bid placed is a binding offer to purchase at that price plus the stated buyer's premium. Bids cannot be retracted.
02Proxy bidding
You may enter a maximum bid. The system bids on your behalf in the listed increment only as needed to keep you in the lead, up to your maximum. Your maximum is never disclosed.
03Soft close
If a bid is received within the final minutes of an auction, the closing time extends so all bidders can respond. Extension length is shown on each listing.
04Reserve
Listings marked with a reserve will not sell below a confidential minimum. Listings with no reserve sell to the high bidder regardless of price.
05Buyer's premium
A buyer's premium (percentage shown on each listing) is added to the high bid to determine the total purchase price.
06Kentucky estate sales tax
Taxable estate and personal property lots carry 6% Kentucky sales tax on the winning bid plus buyer's premium, before any deposit is applied. Lots designated as exempt casual or isolated sales carry no sales tax. Real estate earnest money and refundable bidding deposits are not charged estate sales tax.
07Bidding deposits
Auctions may require a refundable bidding deposit before you can bid. Deposits of bidders who don't win are refunded automatically shortly after the auction closes (allow 5–10 business days for your bank). The winner's deposit is applied toward their payment.
08Deposits & payment
Real estate winners must pay the stated earnest money within 24 hours of auction close and sign the purchase agreement. Personal property must be paid in full (winning bid plus buyer's premium) within 48 hours. Payments are made securely online from the listing page.
09Premier membership
Premier is an optional paid membership that waives bidding deposits on estate and personal property lots. You can cancel anytime and keep benefits until the end of the paid period. Plan changes take effect immediately with the price adjusted.
10Condition
All property is sold as-is, where-is. Descriptions — including AI-assisted drafts — are reviewed by our staff but bidders should inspect and rely on their own judgment.
11Property data
Tax, valuation and property data are obtained from third-party sources and are believed reliable but not guaranteed.
